These Terms of Service (the "Terms") govern your use of the Bin Run mobile application and the website at binruns.com (collectively, the "Service"), operated by BinRun Technologies Inc. ("Bin Run," "we," "us," or "our"), a federally incorporated Canadian corporation with its registered office in Pemberton, British Columbia.
By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
These Terms apply differently depending on whether you use the Service as a Customer (someone who books a waste collection) or as a Hauler (an independent contractor who provides waste collection services). Where a section applies only to one role, this is noted.
1. The Service
Bin Run operates a marketplace platform that connects Customers who need waste collected with independent Haulers who provide collection services.
Bin Run is a technology platform, not a waste collection service. We do not collect, transport, or dispose of waste. Haulers are independent contractors and are not employees, agents, or partners of Bin Run. Bin Run does not direct, supervise, or control the manner in which Haulers perform collection services beyond the requirements set out in these Terms.
We do not guarantee that any specific Hauler will be available at any given time, that a booking will be accepted, or that the Service will be available in any particular area. The Service is currently available in Whistler and Pemberton, British Columbia, with planned expansion.
2. Eligibility
To use the Service, you must:
- Be at least eighteen (18) years of age.
- Have the legal capacity to enter into a binding contract.
- Provide accurate and current information when registering.
- Not be barred from using the Service under applicable law or by Bin Run.
By using the Service, you represent and warrant that you meet these requirements.
3. Your Account
You are responsible for:
- Maintaining the confidentiality of your account credentials.
- All activity that occurs under your account.
- Notifying us immediately at contact@binruns.com of any unauthorized use of your account.
We may suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent or unsafe behavior, or created risk for other users of the Service.
4. Bookings (Customers)
4.1 Placing a Booking
When you book a collection through the Service, you agree to:
- Provide accurate pickup address, scheduled time, and a description of the items to be collected.
- Make the items available at the agreed pickup location and time.
- Comply with the Prohibited Items list in Section 5.
A booking is a binding offer to pay the displayed price upon dispatch of a Hauler.
4.2 Pricing
The base price for a standard household garbage collection is CAD $35.00 per booking. Additional charges may apply for:
- Items beyond standard household garbage volume.
- Items requiring special handling or disposal fees.
- Locations outside the standard service area.
All applicable additional charges will be displayed in the app at the time of booking, before you confirm.
4.3 Taxes
All prices are subject to:
- Goods and Services Tax (GST): 5%
- Provincial Sales Tax (PST), British Columbia: 7%
Taxes are calculated and displayed at checkout and are remitted by Bin Run to the relevant tax authorities.
4.4 Payment
Payment is processed at the time of booking confirmation through our payment processor (Stripe). By placing a booking, you authorize Bin Run, through Stripe, to charge your selected payment method for the full booking amount, including all taxes and applicable fees.
If your payment method is declined, the booking will not be confirmed. You are responsible for ensuring your payment method is valid and has sufficient funds.
4.5 Refunds and Cancellations
Once a Hauler has been dispatched to fulfill your booking, the booking is non-refundable. This is industry standard and reflects the fact that the Hauler has committed time, fuel, and route capacity to your job.
You may cancel a booking without charge before a Hauler has been dispatched. Once a Hauler accepts the job and is en route, cancellation results in forfeiture of the full booking amount.
We may, in our sole discretion, issue partial or full refunds in cases of:
- Failure of a Hauler to arrive within a reasonable time of the scheduled window.
- Failure of a Hauler to complete the collection through no fault of the Customer.
- Verified service failure attributable to Bin Run.
Refund requests must be submitted to contact@binruns.com within seven (7) days of the booking date.
4.6 Pickup Location and Bear-Country Safety
Customers in bear country (including Whistler and Pemberton) must follow safe waste-handling practices and place items at the door at the agreed pickup time, not curbside in advance. Bin Run is not responsible for losses, damage, or wildlife encounters resulting from a Customer's failure to follow safe waste-handling practices.
5. Prohibited Items
The following items may not be tendered for collection through the Service:
- Hazardous waste, including paint, solvents, motor oil, batteries, and chemicals.
- Biomedical waste, including sharps and pharmaceuticals.
- Asbestos-containing materials.
- Explosives, ammunition, or compressed gas cylinders.
- Radioactive materials.
- Stolen property.
- Items that exceed posted weight or volume limits without prior arrangement.
- Items that, by law, require disposal through a specialized regulated channel.
If a Customer presents prohibited items, the Hauler may refuse the items, refuse the entire booking, and the booking remains non-refundable.
6. Hauler Terms (Applicable to Haulers)
6.1 Independent Contractor Status
You acknowledge and agree that:
- You are an independent contractor, not an employee, agent, or partner of Bin Run.
- You have full discretion over when and whether to accept bookings, the routes you take, the vehicle you use (subject to safety and capacity requirements), and the manner in which you complete each job.
- Bin Run does not provide you with vehicles, fuel, equipment, insurance, employment benefits, vacation, sick leave, workers' compensation coverage, or any other benefits typically associated with employment.
- You are solely responsible for your own taxes, including income tax, GST/HST registration and remittance (if your annual revenue exceeds the small supplier threshold), Canada Pension Plan contributions, and any other applicable obligations.
- You are solely responsible for obtaining and maintaining all licenses, permits, and insurance required to lawfully operate as a waste hauler in your jurisdiction, including commercial vehicle insurance and any waste-handling permits.
- Nothing in these Terms creates an employment, agency, partnership, or joint venture relationship between you and Bin Run.
You agree not to make any claim or take any position inconsistent with this independent contractor status.
6.2 Hauler Compensation
For each completed booking, you will receive eighty percent (80%) of the booking value (excluding taxes), with the remaining twenty percent (20%) retained by Bin Run as the platform fee. Payment processor fees are deducted before the split.
Payouts are processed through Stripe Connect (Express accounts) and are subject to Stripe's payout schedule. You are responsible for providing accurate banking information and for resolving any payout failures with Stripe directly.
6.3 Hauler Conduct
While using the Service, you agree to:
- Operate any vehicle safely and lawfully.
- Maintain valid driver's licenses, vehicle registration, and insurance.
- Treat Customers with courtesy and respect.
- Complete bookings you accept in accordance with the agreed scheduled time and pickup details.
- Not solicit Customers for off-platform work.
- Not engage in discrimination, harassment, or unsafe behavior.
- Properly dispose of all collected waste at lawful disposal sites and pay any applicable dump fees.
- Comply with all applicable laws, including environmental, transportation, and waste-handling regulations.
Bin Run reserves the right to deactivate Haulers who fail to meet these standards or who receive consistently negative feedback from Customers.
6.4 Tax Reporting
Bin Run will issue annual income reporting (such as a T4A) to Haulers in accordance with Canadian tax law. You are responsible for accurately reporting and remitting all applicable taxes on your earnings through the Service.
7. User Content
You may submit content to the Service, including photos, descriptions, and feedback ("User Content"). You retain ownership of your User Content. By submitting User Content, you grant Bin Run a non-exclusive, royalty-free, worldwide, sublicensable license to use, store, copy, modify, display, and distribute that content solely for the purpose of operating, improving, and promoting the Service.
You represent and warrant that:
- You own or have the necessary rights to submit your User Content.
- Your User Content does not violate any third-party rights or applicable law.
- Your User Content does not contain unlawful, defamatory, or infringing material.
We may remove User Content that we believe, in our sole discretion, violates these Terms or applicable law.
8. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms.
- Misrepresent your identity or affiliation.
- Use the Service to harass, threaten, or abuse another user.
- Attempt to circumvent, disable, or interfere with the security of the Service.
- Reverse engineer, decompile, or attempt to extract source code from the Service.
- Use automated means (bots, scrapers) to access or use the Service without our express written consent.
- Use the Service to send spam, malware, or unsolicited communications.
- Bin Run reserves the right to investigate and take legal action against violations.
9. Intellectual Property
The Service, including all software, designs, text, graphics, logos, trademarks, and other content (excluding User Content), is owned by BinRun Technologies Inc. or its licensors and is protected by Canadian and international intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose, subject to these Terms. You may not copy, modify, distribute, sell, or create derivative works of the Service except as expressly permitted.
"Bin Run" and the Bin Run logo are trademarks of BinRun Technologies Inc. You may not use them without our prior written consent.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, BIN RUN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
BIN RUN DOES NOT WARRANT THE QUALITY, SAFETY, OR LEGALITY OF SERVICES PROVIDED BY HAULERS. HAULERS ARE INDEPENDENT CONTRACTORS, AND BIN RUN IS NOT RESPONSIBLE FOR THEIR ACTS OR OMISSIONS.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, BIN RUN AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.
BIN RUN'S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID TO BIN RUN IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED CANADIAN DOLLARS (CAD $100).
These limitations apply regardless of the legal theory under which the claim is made and even if Bin Run has been advised of the possibility of such damages.
Some jurisdictions do not allow the exclusion or limitation of certain damages. To the extent such limitations are not enforceable in your jurisdiction, our liability is limited to the maximum extent permitted by law.
12. Indemnification
You agree to indemnify, defend, and hold harmless Bin Run, its officers, directors, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:
- Your use of the Service.
- Your violation of these Terms.
- Your violation of any law or third-party right.
- For Haulers: any claim arising from the performance of waste collection services, including property damage, personal injury, environmental harm, or improper disposal.
13. Termination
You may terminate your account at any time by emailing contact@binruns.com.
We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent or harmful conduct, or created risk for other users.
Upon termination:
- Your right to use the Service ceases immediately.
- Sections that by their nature should survive termination (including Sections 7, 9, 10, 11, 12, 14, 15, and 16) will survive.
- We will retain personal information in accordance with our Privacy Policy.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles.
Any dispute arising out of or relating to these Terms or the Service must be brought exclusively in the courts of the Province of British Columbia, located in Vancouver, BC, and you irrevocably consent to the personal jurisdiction of those courts.
You and Bin Run agree that any claim must be brought in your individual capacity and not as a plaintiff or class member in any class, consolidated, or representative action.
15. Changes to These Terms
We may update these Terms from time to time. When we do, we will:
- Update the "Last Updated" date at the top of these Terms.
- For material changes, notify you in-app and by email at least thirty (30) days before the changes take effect, where reasonably practicable.
Your continued use of the Service after the effective date of any changes constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Service and may terminate your account.
16. General Provisions
- Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Bin Run regarding the Service and supersede any prior agreements.
- Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
- No waiver: Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
- Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms freely, including in connection with a merger, acquisition, or sale of assets.
- Force majeure: Bin Run is not liable for any failure or delay in performance arising from causes beyond our reasonable control, including natural disasters, acts of war, civil disturbance, labor disruption, government action, internet or infrastructure outages, or pandemic.
- Notices: Notices to you may be sent via in-app message or email to the address associated with your account. Notices to Bin Run must be sent to contact@binruns.com.
- Headings: Section headings are for convenience only and do not affect interpretation.
- English language: These Terms are drafted in English. In the event of any conflict between the English version and any translated version, the English version controls. Les parties confirment qu'elles ont demandé que la présente convention soit rédigée en anglais.
